Woman Faces Gun Charge After Drunk Driving Stop

Woman had a valid permit for loaded .22 concealed under her car seat – but the law says that's not cool if you've been drinking liquor and smoking pot.

A 28-year-old Milwaukee woman is facing a weapon charge after she was caught driving impaired through Wauwatosa with a loaded handgun in her SUV.

She had a permit for the gun, but Wisconsin law does not allow anyone to carry a firearm while intoxicated.

At 12:22 a.m. Sept. 2, a Wauwatosa police officer was on patrol in the 10700 block of West North Avenue when he spotted Jackson driving a Mercedes Benz SUV without her headlights on.

Jackson swerved over the center line twice, then sped up and turned northbound on North 113th Street, which is a one-way southbound street. The officer pulled her over in the 2300 block.

Jackson told the officer she had two shots of liquor before driving.

While she was looking for her license, he saw flakes of marijuana on her clothing. Jackson said she had just “smoked a blunt” before leaving a party and the officer saw a baggie of marijuana in her purse.

The officer searched Jackson’s SUV and found an open bottle of vodka and a loaded .22-cal. semiautomatic handgun with 10-round clip under her seat. Jackson has a concealed-carry permit for the weapon.

Jackson failed field sobriety tests and took a Breathalyzer test, which revealed a blood alcohol level of 0.09.

She will make her initial appearance in court Oct. 11.
