Alleged Three-Time Drunk Driver Nabbed by Tosa Cop

An off-duty officer who witnessed a serious accident called 911 and stopped to help, but ended up wrestling the driver into custody.

That 29-year-old Milwaukee man is facing multiple charges, including his third drunken driving offense, after he smashed his car into a light pole, then tried leave the scene and resisted arrest before creating even more havoc at the hospital.

Troy Bruce Cesar was charged Saturday in Milwaukee County Circuit Court with one count of third-offense operating while intoxicated, one count of bail jumping, one count of obstructing an officer and one count of disorderly conduct. If convicted, he faces up to 33 months in prison and $23,000 in fines.

The reason for the bail-jumping charge – he was out on bail from his second drunken driving charge.

According to the criminal complaint:

At 12:48 a.m. Wednesday, Cesar exited I-94 westbound at North 84th Street at a high rate of speed, lost control and ran his car into a utility pole. An off-duty Wauwatosa police officer and another man witnessed the crash and called 911.

The two went to see if Cesar was OK, but another person who saw the crash said he had just left the scene on foot and gone east on O’Conner Street. The officer went after Cesar, caught up and told him to stop, but he kept walking.

The officer put Cesar in an escort hold, but he still kept walking. The officer tried to the next level, a restraint hold, but Cesar continued to resist — and continued even after the officer escalated again and gave him four stiff knee strikes.

It was several minutes before he was able to get handcuffs on Cesar and take him back to the scene, where he turned him over to Milwaukee County sheriff's deputies.

Drunk, injured, really angry and somewhat inappropriate

That ended the Wauwatosa officer's part, but the escapade was far from over.

Cesar hollered at a deputy, using unprintable racial slurs while slurring his speech, that “(Blank) cut me off, (blank) cut me off!”

The deputy smelled alcohol, and when he asked Cesar if he'd been drinking he said he had one beer before driving.

He didn't say how big a beer that must have been.

Cesar was taken to , where he gave a mandatory blood sample without incident. But when medical staff began to treat his injuries from the accident, he got belligerent, saying he didn’t want to pay any medical bills.

And then he began to expose his genitals to a female hospital employee, saying “I know you want to look at my wiener.”

The staff then tried to perform a CT scan on Cesar, but he stood up naked and refused to get inside the machine until a deputy entered the room and ordered him in.

After the scan he called his mother, but then got combative again while staff tried to treat a laceration on his head. He eventually had to be stunned with a Taser and handcuffed to a hospital bed, where he began calling another staff member a racially derogatory name.

Cesar was finally taken to Milwaukee County Jail and on the way kicked a prisoner partition and ripped the bandages off his head.

He was previously convicted of drunken driving in 2010 and was out on bail on a second-offense charge filed April 17 that is still pending in court. He’s currently being held in jail on $1,500 bond.
