More Charges for Tosa Man Accused of Supplying Drugs in Overdose Death

The Wauwatosa man charged with the overdose death of a Fredonia man, has now been charged with felony possession of illicit drugs with intent to deliver.

A criminal complaint filed Friday provides more details into charges against a Wauwatosa man in connection with the overdose death of a Fredonia resident.

Mack E. Scott, 30, was charged with first-degree reckless homicide on May 21 following an investigation of the death of 26-year-old Tyler Bares of Fredonia. He now faces additional charges of possession of heroin, cocaine and marijuana with intent to deliver. 

On May 9, Ozaukee sheriff’s deputies and detectives were called to a Fredonia residence where they found Bares dead. An autospy and evidence at the scene showed he died of an overdose of heroin and/or cocaine.

Members of the Ozaukee County Sheriff’s Detective Bureau and Multijurisdictional Drug Task Force immediately initiated an investigation, that led them to Scott.

Ozaukee sheriff’s deputies and Wauwatosa police took Scott into custody near his Wauwatosa home at 12125 W. Dearbourne Avenue, Apt #2.

Scott was on his way out of the home and drove away in a SUV when authories arrived. Police stopped the car in the 10300 block of West Bluemound Road, and after subsequent vehicle search found baggies containing 7 grams of marijuana, a portable scale and two cell phones.

Investigators obtained and executed a search warrant for Scott’s Wauwatosa home on June 21, which police say revealed his drug-dealing operation. 

In the basement, police say they found 3.6 grams of heroin, 6 grams of cocaine, an empty bottle and full unopened bottle of Dormin, a common cutting agent for heroin, 38 grams of marijuana in baggies and $1,950 in cash. In the kitchen and living room, police found six cell phones, and more marijuana inside a pair of pants.

In a second-floor bedroom, police say they found firearms loaded with ammunition including a Glock Model 17 handgun with a fully-loaded 18-round magazine and one round in the chamber, one 31-round 9mm magazine with nine rounds as well as two spoons containing heroin.

During questioning, Scott told investigators he started selling heroin in January 2013, and said he wasn’t a big time dealer and only sold heroin to support his family.

He admitted to selling heroin in the past to Bares, but denied having a role in his overdose death.

Scott was charged with first-degree reckless homicide under what is called the "Len Bias law," after the University of Maryland basketball star who died of a cocaine overdose in 1986.

A number of federal laws were passed, many of them then adopted by states, including Wisconsin, holding suppliers of drugs criminally accountable for death or injury to those who use them. 

If convicted of the drug charges, Scott could face up to 33 years and six months imprisonment, $110,000 in fines, or both.
