Tosa Man Accused of Beating Grandmother, Selling Pot Out of Her Basement

Police say they found more than 120 grams of marijuana and hashish at a Wauwatosa home after the suspect's 82-year-old grandmother said he struck her with her cane.

A Wauwatosa man is accused of physically abusing his 82-year-old grandmother and selling marijuana out of her basement.

The 29-year-old man, who Patch is not identifying to protect the identity of the victim, was charged Tuesday in Milwaukee County Circuit Court with one felony count of aggravated battery of an elderly person and one felony count of possession of marijuana with intent to sell. If convicted, he could face up to 9 years and six month imprisonment, $20,000 in fines, or both.

On June 13, the victim came into the Wauwatosa Police station to report that her 29-year-old grandson had beaten her.

She said her grandson occasionally lives in her basement rent free, and earlier that day she was cleaning the kitchen and moved his food, which made him angry.

She told police he struck her on the head and hand and then took her adjustable, aluminum cane and struck her on the back of her left hand, causing swelling and bruising, according to court documents. He swung the cane a second time striking her thigh causing swelling and bruising.

Police responded to the home and immediately arrested the grandson for battery. In the basement, police found a pipe commonly used to smoke marijuana, two digital scales, $709 in cash, 89 grams of marijuana plant, 40 grams of hashish, a substance made from the flower of the cannabis plant, according to the criminal complaint. 

The grandson told police the marijuana was his and he sells 7 to 28 grams of pot per week, according to the criminal complaint.

He also told police he became upset with his grandmother when she put his breakfast bars in a box, so he pushed her head with his hands. She pointed her cane at him and he grabbed it and struck her in the thigh with it. He denied striking her a second time.

The suspect is out-of-custody after posting bail, and is due in court June 26 for a preliminary court hearing, according to online court records.
